Trump Disappoints Hawks With Plan to Renew Nuclear Waivers on Iran

Waivers allow continued civil nuclear cooperation

The Trump Administration is about to disappoint a lot of people who see an easy path toward war with Iran, by allowing reason to prevail on international waivers for civil nuclear cooperation with Iran. The waivers will be renewed.

The waivers cover all five remaining parties of the P5+1 nuclear deal, and gives America’s blessing on those nations continuing to cooperate with Iran’s civilian program. Mike Pompeo and John Bolton both objected to the waivers being renewed.

Treasury Secretary Steve Mnuchin, however, noted that if the sanction waivers weren’t renewed, and all those nations stayed in the treaty, the US would be setting itself up to have to start imposing sanctions against every permanent UN Security Council member, and Germany, and target a bunch of companies who got involved in projects when the US was still party to the deal.

Needless to say, that would be a big problem for the US, and Trump ultimately decided not to chance it. At the same time, Pompeo and Bolton both saw this as another big chance to worsen US ties with Iran, continuing the two down a path to war that they’ve been long working for.

Tanker Seizures and Resurgent Imperialism

The British seizure of the Iranian tanker off Gibraltar was illegal. There is no doubt of that whatsoever. The implications for the global economy of the collapse of the crucial international law on passage through straits would be devastating.

It may seem improbable that the UK and or France would ever seek to close the Dover Strait, but in the current crazed climate it is no longer quite impossible to imagine the UK seeking to mess up access to Rotterdam and Hamburg. It is still easier to imagine them seeking to close the Dover Strait against the Russian Navy. Yet the essential freedom of navigation through the Kerch strait, respected by Russia which controls it, is necessary to the survival of Ukraine as a country. For Turkey to close the Bosphorus would be catastrophic and is a historically recurring possibility. Malaysia and Indonesia would cause severe dislocation to Australia and China by disrupting the strait of Malacca and the Suharto government certainly viewed that as an advantage from which it should have the right to seek to benefit, and was a continued nuisance in UN Law of the Sea discussions. These are just a few examples. 

Keeping the Strait of Hormuz open is perhaps the most crucial of all to the world economy, but I hope that the above examples are sufficient to convince you that the right of passage through straits, irrespective of territorial waters, is an absolutely essential pillar of international maritime law and international order. 


The Strait of Gibraltar is vital and Britain has absolutely no right to close it to Iran or Syria. If the obligation on coastal states to keep maritime straits open were lost, it would lead to economic dislocation and even armed conflict worldwide.

Part III of the UN Convention on the Law of the Sea relates entirely to passage through straits.

Please note that the right of passage through straits is here absolute, in a UN Convention which is one of the base blocks of international law. It does not state that the right to transit through straits can be subject to any sanctions regime which the coastal state chooses to impose; indeed it is clearly worded to preclude such coastal state activity. Nor can it be overridden by any regional grouping of which the coastal state is a member.

Jeremy Hunt’s statement to parliament that the Iranian tanker had “freely navigated into UK territorial waters” was irrelevant in law and he must have known that. The whole point of passage through straits is that it is by definition through territorial waters, but the coastal state is not permitted to interfere with navigation.

It is therefore irrelevant whether, as claimed by the government of the UK and their puppets in Gibraltar, the tanker was intending to breach EU sanctions by delivering oil to Syria. There is a very strong argument that the EU sanctions are being willfully misinterpreted by the UK, but ultimately that makes no difference.

Even if the EU does have sanctions seeking to preclude an Iranian ship from delivering Venezuelan oil to Syria, the EU or its member states have absolutely no right to impede the passage of an Iranian ship through the Strait of Gibraltar in enforcement of those sanctions. Anymore than Iran could declare sanctions against Saudi oil being delivered to Europe and close the Straits of Hormuz to such shipping, or Indonesia could declare sanctions on EU goods going to Australia and close the Malacca Strait, or Russia could declare sanctions on goods going to Ukraine and close the Strait of Kerch.

There are two circumstances in which the UK could intercept the Iranian ship in the Strait of Gibraltar legally. One would be in pursuance of a resolution by the UN Security Council under Chapter VII of the UN Charter. There is no such resolution in force. The second would be in the case of a war between the UK and Iran or Syria. No such state of war exists (and even then naval blockade must be limited by the humanitarian measures of the San Remo Convention).

What we are seeing from the UK is old fashioned Imperialism. The notion that Imperial powers can do what they want, and enforce their “sanctions” against Iran, Syria and Venezuela in defiance of international law, because they, the West, are a superior order of human being.

The hypocrisy of arresting the Iranian ship and then threatening war is absolutely sickening.

Finally, there will no doubt be the usual paid government trolls on social media linking to this article with claims that I am mad, a “conspiracy theorist”, alcoholic or pervert. It is therefore worth pointing out the following.(any one we know Craig?)

I both negotiated, and drafted parts of, the Protocol that enabled the Convention to come into force. 

I was the Head of the FCO Section of the Embargo Surveillance Centre and responsible for giving real time political and legal clearance, 24 hours a day, for naval boarding operations in the Gulf to enforce a UN mandated embargo. 

There are very few people alive who combine both my practical experience and theoretical knowledge of precisely the subject here discussed.

Britain Rejects Iran’s Offer to Swap Seized Tankers

Foreign Secretary says Britain will keep Iran tanker, but wants their own returned

Though it is considered virtually a foregone conclusion that the British-held Iranian tanker Grace 1, seized on July 4 and the Iranian-held British tanker Stena Impero, taken weeks later, will ultimately be traded for one another, British officials continue to insist that no such “swap” could happen under international law. 


British Foreign Secretary Dominic Raab said Britain won’t consider a swap and is insisting on international law being upheld. At the same time, he’s arguing that if Iran gives Britain back their tanker, they would be accepted as a responsible member of the international community, albeit a member whose tanker Britain is still going to keep.

British officials argue that the seizure of the Grace 1 is legal based on EU sanctions, which forbid Syria buying oil. There is substantial doubt that the EU can actually enforce this on non-member nations. (Cannot enforce a law agreed between certain parties on a third party who isn't a signatory under International law.......pretty sure the Attorney general or the minister responsible for law can clarify the matter in the UK....IN A FEW SECONDS)
 

Iran says the tanker they captured hit a fishing boat and then refused to contact them, which is likely more legally enforceable since it happened in Iranian waters. The Iranians, however, have made clear that swapping tankers is all they really want.

MT Riah tanker detained by Iran was smuggling oil: So says Panama maritime authority

Panama's maritime authority has confirmed that a tanker operating under the country's flag and seized by Iran in the Persian Gulf last week for smuggling fuel, was indeed in violation of international laws.

The Panamanian Maritime Administration (AMP) on Sunday censured the use of ships chartered by Panama for illegal acts, days after Iran's Islamic Revolution Guards Corps (IRGC) detained the oil tanker MT Riah when it was smuggling one million liters of Iranian fuel in the northern part of the Strait of Hormuz.

“We categorically condemn the use of vessels with a Panamanian flag for illicit acts that threaten the safety of human life,” the AMP underscored in a statement.

The statement further said that “those who clearly violate the laws, conventions and international agreements will be sanctioned and will run the risk that the ship is canceled from the Registry.”

Panamanian Ship Registry on Friday officially started withdrawing the registration of MT Riah after an investigation determined the tanker had "deliberately violated international regulations," the AMP said.

According to specialized international sites, the vessel changed its name four times between 2009 and 2019. The vessel's Dubai-based owner Prime Tankers LLC says it has sold the vessel to Mouj Al-Bahar, another Emirati company.

PressTV-Iran’s IRGC seizes foreign vessel smuggling fuel

Iran's Islamic Revolution Guards Corps (IRGC) has seized a foreign vessel smuggling fuel in the Persian Gulf.

The latest development follows the British seizure of an Iranian oil tanker claiming that it was carrying crude to Syria in violation of the European Union’s unilateral sanctions against the Arab country.

The Grace 1 supertanker, carrying 2.1 million barrels of oil, was seized on July 4 as it transited through international waters off Gibraltar, which is located on Spain's southern tip.

Later that day, Iran’s Foreign Ministry summoned Britain’s ambassador in Tehran, Rob Macaire, to express its strong protest at the move. The envoy was told that the British Royal Marines’ move was tantamount to “maritime piracy.”

Reports say the seizure took place at the request of the United States, which has been bent on driving Iranian oil exports to “zero” as part of its sanctions against the Islamic Republic.

Leader of the Islamic Revolution Ayatollah Seyyed Ali Khamenei denounced Britain’s illegal seizure of the oil tanker, warning that the act of “piracy” will not go unanswered.

On July 19, the IRGC Navy captured British oil tanker Stena Impero for violating international maritime laws when crossing the high-traffic Strait of Hormuz.

Russian Deputy Foreign Minister Sergey Ryabkov said Monday that Iran's arguments for its seizure of the UK-flagged oil tanker were more convincing than those of London.

"Iran’s arguments are much more right than those of Gibraltar and London who are indulging in piracy," Ryabkov said.

Iranian officials says the vessel had switched off its GPS locator, in contravention of international regulations, and was sailing into the strategic waterway in a wrong traffic pattern.

The taker was transferred to the port of Iran’s southern city of Bandar Abbas for maritime casualty investigation.

The Britain has sought a diplomatic solution to the incident and UK Prime Minister Theresa May is to hold a meeting of the emergencies committee on Monday to discuss the issue.

Saudi Arabia, which had itself been holding an Iranian oil tanker for almost 11 weeks, called Iran’s measure to seize Stena Impero "completely unacceptable".

Tehran confirms earlier reports that an Iranian oil tanker that was detained by Saudi Arabia more than two months ago has been released,

Saudi Arabia announced in early May that its coast guard had rescued a distressed Iranian oil tanker with 26 on board off the Red Sea port of Jeddah, after it faced “engine failure and the loss of control.”

According to Iranian officials, the incident had occurred on April 30 while Happiness I was on its way to the Suez Canal, and that water had leaked into the tanker’s engine room.

The Saudis were refusing to let the vessel leave and were, at the same time, demanding that Iran pay $200,000 a day for maintaining the vessel in the port city of Jeddah, some $10 million in total.

The oil tanker, however, was released on Saturday after a series of negotiations.

Nobody else......nobody else save the British Empire decides to bait Iran in its own territorial waters......hoping the Iranians go trigger happy and shoot up a oil tanker in the Persian Gulf.

The Stena Impero was traveling through Iranian side of the Strait when it struck an Iranian fishing vessel. The fishing vessel requested assistance from the Impero which ignored them, turned off their tracking system and tried to exit the scene. So yes, the Iranians detained the tanker for violating any number of maritime laws not the least of which being they left another vessel crippled and in danger of sinking in the water. Russia Prepared to Sell Turkey Advanced Fighter Jets

F-35 not the only option for Turkey

The Pentagon has made a big deal about punishing Turkey by expelling them from the F-35 program, and costing them the opportunity to buy very, very expensive US-made warplanes.

Officials from Russia’s Rostec say they’d be keen to remind Turkey that they also make some really advanced fighter jets of their own, and that Turkey is free to buy Su-35 jets if they can’t buy the F-35. 

The Su-35 isn’t a stealth fighter, like the F-35, but it also costs less than half as much and is still a very advanced multi-role jet in its own right.  It isn’t really competing with the F-35 either since the US is refusing to sell those to them anymore.

The Su-35 has been used as an escort by Russia in Syria, and has become an increasingly popular export for Russia. Egypt announced back in March that they intend to buy over two dozen such planes, a move that similarly led the US to threaten sanctions. (Pakistan maybe will buy some also, as will IRAN)

One does not have to be a professor of strategic studies at Bilkent university to rationalize the very REAL and Imminent threat such projects sponsored by the USA and Israel have against NATO Turkey.

Turkey Announces The Targets Of Its New Air Defense System

Today first parts of the Russian S-400 air defense systems arrived in Turkey. The Russian Ministry of Defense posted a video of the arrival on Facebook. The Turkish Ministry of Defense video showed the unloading of six support vehicles belong to a S-400 set. A complete S-400 set consists of two radars, a command post, eight launch vehicles with four missiles each, and various loader and other support vehicles. Turkey has ordered two complete sets for which it will pay about $2.5 billion.

The U.S. is threatening economic sanctions against Turkey for ordering and receiving the system. It will also kick Turkey out of the F-35 fighter jet program. Turkey was one of the main partners for the F-35 program. It was supposed to receive 100 of the planes and it manufactures parts of the system. Turkey will not receive the ordered planes and those parts will now be made by a U.S. company.

The S-400 system Turkey receives is an export version. It will at first use the 48N6E missiles which have a reach of 250 kilometer. The systems Russia uses include the 40N6E missiles with a reach of 400 kilometers. It will take several months until the first system set in Turkey is complete and operational. So far only 20 Turkish soldiers have been trained on it. 80 more soldiers will arrive in Russia around the end of July to receive their training.

NATO is not amused about the Turkish acquisition:

A NATO official told CNN on Friday that: "It is up to allies to decide what military equipment they buy. However, we are concerned about the potential consequences of Turkey's decision to acquire the S-400 system."The official added that, "interoperability of our armed forces is fundamental to NATO for the conduct of our operations and missions."

The S-400 in Turkey is not supposed to be interoperable with NATO. The most likely initial deployment area for the new system will be around Ankara to protect the wannabe-Sultan Erdogan from potential U.S. or Israeli attacks.

The government controlled Turkish news agency Anadolu made it abundantly clear what the system is supposed to target.

The lower part says: "The system can eliminate" and then shows the silhouettes and names of U.S. military bomber, fighter and radar planes as well as Tomahawk cruise missiles. The only one missing is the 'invisible' F-35 which the S-400 can of course also detect and eliminate.

The second S-400 set will likely be stationed on Turkey's southern coast from where it can cover Cyprus and protect Turkish oil interests in the eastern Mediterranean sea. Turkey recently started drilling around Cyprus. North Cyprus is occupied by Turkey since 1974. But its claims for exploration rights extend even to the south of the island and recently started drilling there.

The European Union, which does not recognize Turkey's occupation of north Cyprus, signaled that it will sanction Turkey over it.

Turkey's relation with the U.S., NATO and the EU are likely to get worse. Russia's slow but steady strategy to draw Turkey to its side is progressing very well. With the F-35 purchase canceled Turkey will have to look to Russia for acquiring modern fighter planes. An order will depend on the manufacturing share Russia is willing to hand over to Turkey.

The Turkish economy is not well. Its aggression in Syria and Libya proved to be costly. President Erdogan recently fired the chief of the Turkish central bank who was not willing to lower the interest rate. Erdogan believes that high interest rates cause high inflation while 99% of all economists believe that higher interest rates are the best way to fight inflation.

Many Turkish companies and private households took out loans that are denominated in Euro or U.S. Dollar. If the central bank lowers the interest rate the Turkish Lira will sink and repaying the loans will become more expensive. New U.S. and EU sanctions will make these problems worse.

Erdogan may soon have an air defense system that can protect Turkey's capital. But the move will cost the country, and Erdogan, in many other fields. Russia is the country that wins from Turkey's problems. One hopes that it will use the leverage it gains over Turkey to remove the Turkish invasions from Syria.
