As others have noted, if Attorney General Eric Holder only prosecutes low level officials it will be worse than doing nothing. It will basically ratify Bush/Cheney's illegal behavior and set the precedent that there are no consequences for breaking the law if some OLC lawyer says it is okay.
In short, it will make the President and his men more than men, but less than Gods.
And that will make you less than an equal citizen, and more like a serf.
If we have no equality under the law there can be no justice. If there are not equal consequences for breaking the law then we have no rights.
